6 December, 2023According to article 35 paragraph 1 paragraph 7 of the General Collective Agreement for the private sector (OKDPS) the rules for the payment of vacation pay in the private sector of the economy are determined. According to them, the employee has the right to:
Recourse for annual leave in the amount of at least 40% of the base (average monthly net salary per employee in the Republic of Moldova paid in the last three months), provided that the employee has worked for at least 6 months in the calendar year with the same employer.
With a collective agreement at the level of activity or a collective agreement at the level of the employer, recourse for annual leave can be determined in an amount greater than the amount determined by this collective agreement.
Recourse for annual payment is paid once during the year. The amount is determined according to the basis valid on the day of adoption of the Payment Decision.
In the case of employers who have encountered difficulties in their work, after assessing the economic and financial situation of the employer, after mandatory prior consultation with the trade union at the branch or department level, with an agreement signed by the employer and the representative trade union organization, annual payment compensation can be determined at a lower amount of the amount determined by this collective agreement.
In the case of employers who have not formed a trade union, the agreement is signed by a representative elected by the workers.
