28 February, 20232023: NO RIGHT TO OFFER / GIVE DISCOUNT when payment is made in cash
The latest information on the amount of the cashier’s maximum (its insurance), the monthly amount of the allowed amount for cash payment, etc., we draw your attention to another NEWS in this section, which has ALL legal entities (before RETAILERS) which are charged in cash.
Pursuant to Article 77 paragraph 5 of the NEW Law on Payment Services and Payment Systems (90/22):
“The recipient is not entitled to offer a discount if the payment transactions are carried out with cash.”
The recipient is a legal or physical person for whom the funds that are the subject of the payment transaction are intended (Art. 2.110 of the ZPUPS).
This prohibition on offering (giving) discounts applies to payment transactions that are carried out exclusively with cash, directly from the payer to the recipient, without the involvement of an intermediary.
Cash is paper money and coins (Art. 2.79 of the ZPUPS).
If the recipient offers (gives) a discount for payment in cash, the Law (ZPUPS) establishes a fine in the amount of:
500 to 1,000 euros in Denar equivalent for a micro trader,
1,000 to 2,000 euros in Denar equivalent for a small trader,
3,000 to 6,000 euros in Denar equivalent for a medium trader and
7,000 to 10,000 euros in Denar equivalent for a large trader
In addition to the fine, the trader will also be given a misdemeanor sanction, a ban on performing activities for a period of three months to two years.
Fine for responsible person
A fine in the amount of 300 to 500 euros in denars will be imposed on the responsible person at the merchant. In addition to the fine, the responsible person at the merchant will also be given a misdemeanor sanction, a ban on performing duties for up to one year.
